Welcome to Attendance Manager. These Terms of Service ("Terms") govern your access to and use of the Attendance Manager website, services, and applications (the "Service"). Please read them carefully before using the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service.

1. Acceptance of Terms

By creating an account or using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into this agreement. If you are using the Service on behalf of an organization, you agree to these Terms on behalf of that organization.

2. Description of Service

Attendance Manager provides a web-based HR and attendance management solution designed to help organizations track employee check-ins via QR code, manage leaves and work shifts, and generate attendance reports. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

3. Account Registration and Security

To access certain features, you must register for an account. You agree to:

  • Provide accurate, current, and complete information.
  • Maintain the security of your password and account credentials.
  • Promptly update your account information to keep it accurate.
  • Be fully responsible for all activity that occurs under your account.

4. User Conduct and Responsibilities

You agree not to use the Service to:

  • Violate any local, national, or international law or regulation.
  • Impersonate any person or entity or misrepresent your affiliation.
  • Interfere with or disrupt the Service or servers connected to the Service.
  • Attempt to gain unauthorized access to any part of the Service.
  • Use automated systems to access the Service in a manner that sends excessive requests.

5. Intellectual Property Rights

All content, features, and functionality of the Service — including text, graphics, logos, and software — are the exclusive property of Attendance Manager or its licensors, protected by international copyright and intellectual property laws.

6. User Content

You retain ownership of any data you upload to the Service ("User Content"). By uploading, you grant Attendance Manager a worldwide, non-exclusive, royalty-free license to host, store, and process your data solely to provide the Service to you.

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information.

8. Subscription, Fees, and Payments

Some parts of the Service are billed on a subscription basis.

  • Billing: You will be billed in advance on a recurring basis (monthly or annually), processed securely through Lemon Squeezy as our Merchant of Record.
  • Cancellations: You may cancel your subscription at any time through your account settings. Access continues until the end of the current billing period.
  • Refunds: Except where required by law, paid subscription fees are non-refundable. Please refer to our Refund Policy for details.

9. Termination

We may terminate or suspend your account immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the Service will cease immediately.

10. Limitation of Liability

To the maximum extent permitted by law, Attendance Manager and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill, resulting from your use of the Service.

11. Disclaimer of Warranty

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Côte d'Ivoire, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice before new terms take effect. Continued use of the Service after revisions constitutes acceptance of the new Terms.

  • Attendance Data: Check-in and check-out timestamps, total hours worked, and related records generated through use of the Service.
  • Log Files: IP addresses, browser type, Internet Service Provider, date/time stamps, and referring pages — standard server log data.
  • Payment Information: Payment processing is handled entirely by Lemon Squeezy. We do not store credit card numbers or financial data on our servers.

2. How We Use Your Information

  • Provide, operate, and maintain the Service.
  • Process attendance records and generate reports for your organization.
  • Improve and expand the Service's features and functionality.
  • Communicate with you regarding updates, support, and account activity.
  • Detect and prevent fraudulent or unauthorized activity.

3. Data Storage and Security

We use industry-standard security measures to protect your data from unauthorized access, disclosure, or destruction. Your data is stored on secure servers. However, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.

4. Sharing of Data

We do not sell, trade, or rent your personal information to third parties. We may share data with trusted third-party service providers (such as hosting and payment processors) strictly to operate the Service. These providers are bound by confidentiality obligations.

5. Third-Party Services

Payment processing is handled by Lemon Squeezy (Merchant of Record). Their privacy practices are governed by their own privacy policy. We also use standard hosting infrastructure to serve the application.

6. GDPR Data Protection Rights

If you are located in the European Economic Area, you have the following rights regarding your personal data:

  • Right to access: Request copies of your personal data.
  • Right to rectification: Request correction of inaccurate information.
  • Right to erasure: Request deletion of your personal data under certain conditions.

No refunds policy. All payments made for Attendance Manager subscriptions are final and non-refundable, except where explicitly required by applicable law.

Thank you for choosing Attendance Manager. Please read this Refund Policy carefully before subscribing to any paid plan.

1. General Policy

All subscription fees paid to Attendance Manager are non-refundable. Once a payment has been processed, we do not issue full or partial refunds for any reason, including but not limited to:

  • Early cancellation of a subscription before the end of a billing period.
  • Unused time remaining in a current subscription period after cancellation.
  • Change of mind or decision to switch to a different plan or competitor.
  • Failure to use the Service during the subscription period.

2. Free Trial

We offer free trial periods on our Pro (14 days), Business (14 days), and Enterprise (30 days) plans. We encourage you to take full advantage of the free trial to evaluate the Service before committing to a paid subscription. No charge is made during the trial period, and you may cancel at any time before the trial ends without being billed.

3. Cancellation

You may cancel your subscription at any time from your account settings. Upon cancellation:

  • Your subscription remains active until the end of the current billing period.
  • You will not be charged for the next billing cycle.
  • No refund will be issued for the remaining days of the current period.
  • Your account will revert to the free Starter plan after the period ends.

4. Exceptions

Refunds may be considered solely in the following exceptional circumstances:

  • Duplicate charges: If you were charged twice for the same billing period due to a technical error.
  • Legal requirement: Where a refund is explicitly required by the consumer protection laws applicable in your jurisdiction.

To request a review of an exceptional case, contact us within 7 days of the charge at [email protected] with your order details. We will review each case individually.

5. Payment Processing

All payments are processed securely by Lemon Squeezy, our Merchant of Record. Lemon Squeezy handles all billing, invoicing, and tax compliance on our behalf. If you have billing disputes, you may also contact Lemon Squeezy directly through their support channels.

6. Changes to This Policy

We reserve the right to modify this Refund Policy at any time. Changes will be posted on this page with an updated effective date. Continued use of the Service after changes constitutes acceptance of the revised policy.
